Kinsman trail update

To the Editor,
I am writing to bring attention to an ongoing issue regarding property rights, land encroachment, and the Mt. Kinsman Trail in the Town of Easton.
For decades, significant encroachment and unpermitted trail development have impacted my land (Lot 54-D). Despite past agreements and joint efforts with local landowners—including the White Family Trust—to manage and properly relocate trail sections to higher ground, Mike Kenney (“Tamarack Green Recreation”) has continuously expanded unapproved trail networks, commercialized hiking and mountain biking operations, and established parking access across private boundaries.
Key issues surrounding this property dispute include:
– Unauthorized Trail Expansion & Encroachment: The creation and monetization of trails across private land without consent, including the “Button Fern” trail, leading to severe land-use conflicts and property line disputes.
– Refusal to Relocate Trail Sections: Failure to complete the planned relocation of the upper Kinsman Trail to suitable ground, resulting in environmental damage and interference with active agricultural land and sugarbush maintenance.
– Boundary & Access Issues: Encroachment along the 50-foot right-of-way, missing property pins along Route 116, and commercial usage of nonconforming lots adjacent to private property.
Proper resolution requires merging affected lots, restoring property boundaries, relocating the Kinsman Trail to agreed-upon lands, and holding commercial operators accountable for unauthorized use of private property. Local authorities, trail associations, and the community must address these ongoing trespass and land-use violations.
This is a very good synopsis of this:
Title: Kinsman Trail Betrayal
“Felony Trespass” Mike Kenney/“Tamarack Green Recreation” (White Mountain National Forest/Appalachian Mountain Club) (jail time requested)
The Mt. Kinsman Trail passes across our property 5400’ between New Hampshire route 116 and the White Mt. National Forest, with Mike Kenney owning 5100’ of trail frontage and myself 5700’. (See Town of Easton Tax Map #1) Mike Kenney granted 50’ wide 1000’+ long right of way to his landlocked lot 54-E, across my lot 54-D
Three levels of “trespass” happening:
1. Mike Kenney’s thousand foot plus 50 foot wide right of way is not trespassing, or is it, “encroachment”? I will get to this later.
2. Mike Kenney’s ROW turns into a property line for the rest of the 3000’+ to the National Forest, where Mike Kenney’s hiking ‘clients’, “trespassing” becomes an issue.
3. Summer of 2026 Mike Kenney opens up his “Button Fern” trail for hikers, that runs half mile across my lot 54-D. I “posted” it in late August, and here I am with “felony trespassing”.
The “betrayal” comes with Mike Kenney refusing to relocate the upper portion of the Kinsman Trail, as planned. In 2008, we moved (Dr. Eric White, 80+ years) Williamstown Mass. of the White Family Trust, Mike, and myself) the “trailhead” .2 mile south onto White land, with alacrity, in 2008. This was spearheaded by Mike Kenney as he cuts in a trail that only goes half-way up and joins the old trail. Eric White, Jennifer Burnett of the WMNF, and I, using GPS, laid out the upper portion of the trail that Mike Kenney never finished.
Try as I might I could never get Mike Kenney to relocate that upper portion, environmental disaster, 100-200 yards to the south. So instead of moving the upper portion of the trail to higher ground, cooperating with the ‘neighbors’, Mike Kenney moves the trailhead back to the town-line and monetizes with parking fees, first building a parking lot on my lot 54-D, quickly finding out that I don’t want any ‘parking lot on my property, consequently moving across the property line over onto his property, lot 54-C, quickly cleared and built another parking lot, and overcoming any “driveway permit” issues with the state, ready for the Memorial Day crowds 2025. At this point I called in one Trooper Estes from Troop F. Trying to get a ‘restraining order’ of some sort, or shut down the ‘trail’, and move it back to the White property trailhead.
A year or so ago Eric White and his brother Jody paid me a visit and we checked out their 60 acre “current use” lot (trailhead) regarding Mike Kenney mountain bike trails on their property. We found an extensive network of trails using the Mt. Kinsman hiking trailhead as a base. There are a different set of liability issues for mountain bike trails. And recently Eric White was visiting, came up to roughly inspect the situation on the ground and visit the ’selectmen’ meeting, being one of the larger land owners in the town. We laid out the Tax Map (#1) and went over everything, and could commiserate regarding the ‘trespasser’ Mike Kenney. He did reaffirm, again, his willingness to host the Mt. Kinsman Trail, no charge.
Between 2006 and 2016 Mike Kenney creates for himself a land locked Lot 54-E, 70 +/-acres turning the Mt. Kinsman trail into a property line, thus destroying an iconic sugarbush and my livelihood. For many years I tapped the trees, and even to this day I still do “timber stand improvement”, “releasing” the sugar maples, even with the inconvenience/ interference of ever growing numbers of hikers. It is imperative that the two lots, 54-D and 54-E be merged for the sake of the ‘iconic’ sugarbush and the trail relocated back and the top section moved to higher ground.
The missing pin. Mike Kenney’s lot 54-C, 3 acre nonconforming (all land in the Town of Easton is either farm or residential land) commercial lot (he has since sold the business, but still owns the lot?) abuts my lot 54-D. Around 2010 pulled the corner pin 150’ east of rt. 116, 50’ south of the Easton Franconia town-line, to make room for driveway/parking. He has now sold the commercial business. I would like this parcel, 54-C, merged with my lot 54-D.
This “felony trespass” is the culmination of years, decades, of ‘encroachment’, significant encroachment.
I request/recommend ten years confinement, fives years if Mike Kenney turns over lots 54-C and 54-E.
No time served if Mike Kenney turns over all his land/property, he can have a ‘life estate’ in current residence.
I would like all “receipts” from “Tamarack Green Recreati
So, when I try to get some sort of enforcement action, arrest and jail time, I get laughed out of town. The Town of Easton has a copy of this home-made indictment, but is not expected to do anything other than lodge a copy in the Town offices. They refer me to Troop F, then I am sent to the Franconia Police, but it is out of their district (Easton), and then finally referred to the Sheriff’s department. Now the Sheriff’s Department is claiming Mike Kenney has a right to run his business on my land (shell company “Tamarack Green Recreation”) based on Mike Kenney operating for over a year (squatters right?) Now, these law enforcement guys are no wet noodles, heavily armed. They had no trouble arresting and jailing me at the point of a gun back in the seventies, twice, for nothing (marijuana). “Incident at Little River” (Twin Mt.) and “The Kingpin” (SWAT Team home invasion)
The only solution? I run for Governor (write-in), straighten this retarded State of New Hampshire right out. Credentials: I been around a long time, rumor has it my ancestor patriot William Kenney fired the shot (one of the shots, Nathan Kinsman fired the other) “heard ’round the World” back in April 19,1775. William Kenney, 19, Nathan Kinsman, 34, French and Indian War hardened from the wilds of New Hampshire. They were like Batman and Robin and along with Nathan Hale secured the victory, although a pyrrhic victory.
By the way, Kelly Ayotte was attorney general during the assassination/psyop of Resident (Liko) Kenney. I have a lot of questions for her.
I know it is futile, but I am trying to get a lawyer, but not trying very hard. I know all too well: “Plate sin with gold and the strong lance of Justice hurtless breaks”. (Shakespeare)
Sincerely,
William Kenney
